Defense filed Motions to Suppress evidence by an unlawful seizure and lack of probable cause to arrest. GRANTED. Erie Court of Common Pleas suppressed all evidence for a lack of probable cause and unlawful arrest. Commonwealth appealed to Pennsylvania Superior Court.
