Commonwealth v. GR (2nd Offense DUI .17)

Client was charged with a second incident of DUI >.16 and subject to an automatic 90 days in jail, 1 year license suspension to be followed by mandatory 1 year ignition interlock requirement. Defense filed Motions to Suppress evidence by an unlawful seizure and lack of probable cause to arrest. GRANTED. Erie Court of Common Pleas suppressed all evidence for a lack of probable cause and unlawful arrest. Commonwealth appealed to Pennsylvania Superior Court.

AFFIRMED. Pennsylvania's 2nd highest Court of Appeals upheld the lower Court's ruling, excluding all evidence and ultimately leading to the dismissal of all charges.
