Defendant was on Diversion Agreement in another Court when this case arose. Prosecutor would not negotiate so we were forced to litigate and the Court dismissed the case for lack of probable cause to arrest after we were able to suppress PBT and HGN evidence supporting the arrest on foundational grounds. Diversion agreement not revoked by other court!!
